1. Agreement to Terms

These terms are an agreement between you and SystemsMaker, a DBA of FTP Travel LLC ("SystemsMaker," "we," or "us").

By accessing or using SystemsMaker's website and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Description of Services

SystemsMaker provides website design, development, and business automation services for contractors and home service businesses. Our services include:

• Free websites, with optional hosting on your own domain
• Custom website design and development
• Missed-call text-back automation
• AI chat agent integration
• Online booking systems
• Review request automation
• Follow-up email and SMS sequences

2a. Free Website and Hosting

• The free website. We build a website for your business from the details you give us and from public information about your business, such as your current website and your Google listing. Building it and looking at it cost nothing, and no card is needed.
• The files are yours, free. Ask and we will send you your website's files at no cost. You own your business content (your name, logo, photos, text, and other details) and the website files we deliver to you, and you can host them anywhere you like. We keep ownership of our general templates and tools, so we can keep using them for other customers. That does not limit your use of your files.
• Hosting. If you want us to host the site on your own domain, that is our website plan, at the price shown at checkout (currently $59/mo). It starts with a 30-day free trial. We collect your card when the trial starts, and we don't charge it during the trial. When the trial ends, your card is charged the plan price, and then again every month until you cancel.
• Cancel anytime. Cancel during the trial and you are never charged. After that, cancelling stops future charges (see section 7).
• 30-day money-back. If you're not happy, email us within 30 days of your first payment and we will refund that payment in full (see section 3a).
• When hosting ends. Your site comes off our hosting. Your domain stays yours, and you can ask us for your website files.

3. Subscription and Payment

Our services are provided on a monthly subscription basis:

• Paid plans are billed monthly, or yearly if you choose annual billing. Each charge pays for the period that follows it
• The website plan starts with a 30-day free trial, so its first charge comes when the trial ends (see section 2a)
• No contracts. No setup fees. Cancel anytime
• Pricing is subject to change with 30 days notice

3a. Refunds — 30-Day Money-Back Guarantee

Every SystemsMaker subscription comes with a 30-day money-back guarantee:

• If you're not satisfied for any reason within 30 days of your first payment, email systems@systemsmaker.com and we will refund that payment in full — no questions, no hoops.
• Refunds are issued to your original payment method, typically within 5–10 business days.
• After the first 30 days, you can still cancel at any time. Cancellation stops future charges; payments already made for the current billing period are not refunded, and your service stays active through the end of that period.
• There are no contracts, no setup fees, and no cancellation fees — ever.

You can update your card or cancel yourself at any time, with no phone call. Go to systemsmaker.com/welcome (the page you see after checkout), tap "Manage billing" at the bottom, and enter the email you signed up with. We email you a secure link to your billing page, where you can update your card or cancel. Or email systems@systemsmaker.com and we will do it for you.

4. Your Responsibilities

As a customer, you agree to:

• Provide accurate and complete information about your business
• Maintain the confidentiality of your account credentials
• Notify us promptly of any unauthorized access
• Use our services only for lawful business purposes
• Not use our services for spam, fraud, or illegal activities

4a. SMS Messaging Program

The public program terms, opt-in form, STOP/HELP rules, and support contact live on our SMS Terms page. This section is a summary of the same program.

Program name: SystemsMaker Sales & Support SMS (operated by SystemsMaker, a DBA of FTP Travel LLC).

Description: When you submit your phone number and actively check an SMS consent box on systemsmaker.com, you agree to receive SMS messages from SystemsMaker related to that request. Messages include site preview links, claim links, demo phone numbers, sign-up / payment links, appointment confirmations, onboarding notices, and support follow-ups related to your inquiry or subscription.

Message frequency: typically 1–5 messages per active request, plus service messages for paying customers when needed.

Message & data rates may apply from your mobile carrier.

Opt out: Reply STOP to any of our text messages at any time. Your number is added to our do-not-contact list immediately, and no further messages will be sent.

Help: Reply HELP to any message for assistance, or contact our support team at systems@systemsmaker.com or 1-629-230-2759.

Privacy: See our Privacy Policy for how we handle SMS-related data. We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.

Supported carriers include AT&T, Verizon, T-Mobile, and other major U.S. mobile providers. Carriers are not liable for delayed or undelivered messages.

5. Intellectual Property

Our Property: SystemsMaker keeps ownership of our platform, software, general templates and tools, and the other systems we use for all our customers. This does not take away anything that is yours under section 2a, including the website files we deliver to you.

Your Content: You retain ownership of your business information, logos, photos, and content you provide. You also own the website files we deliver to you (see section 2a).

Domain Names: Domain names registered on your behalf are your property.

6. Service Level

We strive to provide reliable service and will make reasonable efforts to:

• Keep your website online and accessible
• Respond to support requests within 24 business hours
• Notify you of planned maintenance in advance
• Resolve technical issues in a timely manner

7. Cancellation

You may cancel your subscription at any time. Upon cancellation:

• Your service will remain active until the end of your current billing period (or your free trial)
• Domain names you own can be transferred to you
• When service ends, your website comes off our hosting. Ask us for your website files and we will send them, free
• We may retain certain data as required by law

8. Limitation of Liability

To the maximum extent permitted by law, SystemsMaker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless SystemsMaker from any claims, damages, or expenses arising from your use of our services, your content, or your violation of these terms.

10. Governing Law

These Terms shall be governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Davidson County, Tennessee.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or through our website. Continued use of our services after changes constitutes acceptance of the new terms.
